Appellate Litigation

Litigating cases on appeal is an area most lawyers avoid. Eleventh Circuit

The Eleventh Circuit Court of Appeals hears appeals from federal cases in Georgia, Alabama, and Florida, with eleven active federal judges plus several senior judges. Strickland Brockington Lewis attorneys have argued several cases before the Eleventh Circuit, winning results for their clients.

In Dale v. Comcast, SBL partner Anne Lewis argued a case resulting in the first Eleventh Circuit precedent striking down an arbitration clause in a consumer contract. SBL attorneys have argued cases on telecommunications law, defended the state’s photo identification requirement for voting, and defended a Georgia city at the Eleventh Circuit.

Georgia Supreme Court

The Georgia Supreme Court is one of the busier Supreme Courts in the country, hearing thousands of cases each year. Strickland Brockington Lewis attorneys are at the forefront of monitoring the civil cases heard by the Court through SBL’s Supreme Court of Georgia (SCOG) Blog. The blog tracks each of the civil cases heard by the Supreme Court, summarizes the issues, and analyzes statistics about the court and its decisions.

SBL partner Anne Lewis won a case on behalf of consumers in Southstar Energy Services v. Ellison, successfully persuading the Court to unanimously uphold a split Court of Appeals verdict and protect the rights of consumers. SBL has also litigated election cases, including the defense of Georgia’s photo identification statute, in the Georgia Supreme Court.

Georgia Court of Appeals

The Georgia Court of Appeals is the busiest appellate court in the nation, hearing thousands of cases with a small amount of judges within two “terms” of court every year. Strickland Brockington Lewis attorneys regularly handle appeals to the Court of Appeals, which must hear the cases submitted to it.

Many cases SBL has handled in the Court of Appeals proceeded to the Supreme Court, including Southstar Energy Services v. Ellison, where SBL partner Anne Lewis persuaded a narrowly-divided Court of Appeals to overturn a trial court’s decision. That decision was eventually upheld unanimously by the Georgia Supreme Court.

United States Supreme Court

The United States Supreme Court is the highest court in the United States and has the final word on issues involving federal law. Not many firms have the opportunity to practice before the Supreme Court, but Strickland Brockington Lewis attorneys have been involved in many cases in that venue.
